Annex III – High-Risk Categories
The Eight High-Risk Areas
Annex III defines eight areas in which AI systems are classified as high-risk:
1. Biometrics (where permitted under national law)
- Remote identification systems
- Biometric categorisation based on sensitive attributes
- Emotion recognition

2. Critical Infrastructure
AI as a safety component in the management and operation of critical digital infrastructure, road traffic, water, gas, heating or electricity supply.

3. Education and Vocational Training
AI for determining access to educational institutions, assessing learning outcomes, monitoring examinations.
BAUER GROUP Relevance: ❌ Not a business area
4. Employment, Workers Management, Access to Self-Employment
- AI for recruitment and personnel selection (No. 4a)
- Decisions on promotion, termination, task allocation
- Performance evaluation and behavioural monitoring

5. Access to Essential Private and Public Services
- Creditworthiness assessment
- Risk assessment for life/health insurance
- Evaluation of emergency calls and triage systems

6. Law Enforcement
Polygraph equivalents, evidence assessment, risk assessment, profiling.

7. Migration, Asylum, Border Control
Risk assessment, asylum processing, document verification.

8. Administration of Justice and Democratic Processes
AI in judicial and electoral processes.

BAUER GROUP Summary
Of the eight Annex III categories, at most two are potentially relevant for the BAUER GROUP:
- No. 2 (Critical Infrastructure) — only if AI systems are deployed as safety components in the control of critical infrastructure
- No. 4 (Employment) — only if AI-assisted HR systems are developed or marketed under the company's own name
All other categories are not relevant to the BAUER GROUP business model.
