CE Marking – Art. 48

Requirement

High-risk AI systems must bear the CE marking to indicate conformity with the AI Act.

Affixing

The CE marking shall be affixed to:

1. The AI system itself (for physical products) — visible, legible, indelible
2. The packaging — where affixing to the system is not possible
3. The accompanying documentation — as a last resort

Rules

• Must be affixed before placing on the market
• Must comply with the format pursuant to EU harmonisation legislation (minimum height 5 mm)
• For software without a physical product: in the digital documentation and, where applicable, in the UI

Synergies with CRA

Where the product already bears a CRA CE marking, the AI Act conformity is integrated into the same declaration. No duplicate CE marking is required.
